OVERVIEW
Welcome to It's Bubbles O'clock! The terms "we", "us" and "our" refer to It's Bubbles O'clock. It's Bubbles O'clock operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience ("the Services"). It's Bubbles O'clock is powered by Shopify, which enables us to deliver the Services to you.
The terms and conditions below, together with all policies referred to herein (these "Terms of Service" or "Terms"), describe your rights and obligations when using the Services. Please read these Terms of Service carefully, as they contain important information about your legal rights and cover areas such as disclaimers and limitations of liability.

SECTION 1 – ACCESS AND ACCOUNT
By accepting these Terms of Service, you confirm that you are of legal age in your country of residence and that you have given us your consent to allow your minor children to use the Services on devices that you own, purchase or manage.
To use the Services, including when accessing or browsing our webshop or purchasing the products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You represent and warrant that all information you provide in our store is accurate, current and complete, and that you hold all necessary rights to provide such information.
You are solely responsible for maintaining the security of your credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 – OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our webshop. Please note, however, that colours or the appearance of a product may differ from what you see on your screen, depending on the type of device you use to access the store and your device settings and configuration.
We do not guarantee that the appearance or quality of the products or services you purchase will meet your expectations or be 100% identical to those depicted or reproduced in our webshop, as minor variations in print and materials may occur.
All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue the sale of any product at any time and may limit the quantity of products we offer to any individual, geographic area or jurisdiction, on a case-by-case basis.

SECTION 3 – ORDERS AND ON-DEMAND PRODUCTION
When you place an order, you are making an offer to purchase. It's Bubbles O'clock reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.
Please note: Our products are manufactured on demand (Print-on-Demand) through our partner, Printful. This means that production of your item does not begin until your order has been accepted. Please review your order carefully before submitting it, as we may not be able to accommodate cancellation requests once production has commenced. In the event that we do not accept, modify or cancel an order, we will endeavour to notify you by contacting you at the email address, billing address and/or phone number provided at the time of ordering.
Your purchases may only be returned or exchanged in accordance with our Refund Policy [INSERT LINK TO REFUND POLICY]. You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service is the price in effect at the time the order is placed and will be stated in your order confirmation email.
VAT-exempt trading: As It's Bubbles O'clock is operated as a non-VAT-registered hobby business, no VAT is added to our products. Unless expressly stated otherwise, the prices shown do not include shipping, handling, customs duties or import charges, which may apply to deliveries outside the EU.
Prices in our webshop may differ from prices in physical stores or in webshops or other stores operated by third parties. We may from time to time offer promotions on the Services that may affect prices and that are subject to terms and conditions different from these Terms. In the event of any inconsistency between the terms of a promotion and these Terms, the promotional terms shall prevail.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address, credit card numbers and expiry dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct and complete, (ii) you are duly authorised to use that credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay the charges incurred by you at the stated prices, including shipping and handling fees.

SECTION 5 – SHIPPING AND DELIVERY
As our products are manufactured on demand, there is a production time prior to dispatch. The expected total delivery time (production and shipping) is typically 5–10 business days within the EU.
We are not responsible for delays in shipping and delivery. All delivery times are estimates only and cannot be guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Once we have handed the products over to the carrier, title and risk of loss pass to you.

SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, screenshots, images, graphics, product reviews, video and audio, as well as the design, selection and arrangement thereof, are owned by It's Bubbles O'clock, its affiliates or licensors and are protected by Danish and international intellectual property laws.
These Terms grant you the right to use the Services solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent. Unless expressly stated herein, nothing in these Terms grants or shall be construed as granting you a licence or any other rights under any patent, trademark, copyright or other intellectual property belonging to It's Bubbles O'clock, Shopify or any third party. Unauthorised use of the Services may constitute a violation of intellectual property law. All rights not expressly granted herein are reserved by It's Bubbles O'clock.
It's Bubbles O'clock's names, logos, product and service names, designs and slogans are trademarks of It's Bubbles O'clock or its affiliates or licensors. You may not use such trademarks without prior written permission from It's Bubbles O'clock. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS
You may have access to customer tools offered by third parties as part of the Services, which we neither monitor, control nor have any influence over.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We assume no liability arising from or in connection with your use of optional third-party tools.
Any use of optional tools offered through the website is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which the tools are provided by the relevant third-party provider(s).
We may also in the future offer new features through the Services (including the release of new tools and resources). Such new features shall also be considered part of the Services and subject to these Terms of Service.

SECTION 8 – THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including integrated third-party features). We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites that you choose to access. If you decide to leave the Services to access such materials or third-party websites, you do so at your own risk.
We are not responsible for any damages or losses related to your access to third-party websites or your purchase or use of products, services, resources or content on third-party websites. Please carefully read and ensure that you understand the third party's policies and procedures before entering into any transaction. Complaints, claims, concerns or questions regarding third-party products and services should be directed to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
It's Bubbles O'clock is powered by Shopify, which enables us to deliver the Services to you. However, all purchases and sales you make in our store are made directly with It's Bubbles O'clock. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspects of sales between you and It's Bubbles O'clock, including damages, harm or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or in connection with your purchases and transactions with It's Bubbles O'clock.

SECTION 10 – PRIVACY POLICY

As the Services are hosted by Shopify, Shopify collects and processes personal data about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transferred to and shared with Shopify and third parties, which may be located in countries other than the country in which you live, for the purpose of delivering services to you.

You also represent and warrant that: (i) you own or hold all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are not and will not be obligated to (1) treat your Feedback as confidential, (2) pay compensation for your Feedback, or (3) respond to your Feedback.
We may, but are not obligated to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or in violation of any party's intellectual property or these Terms of Service.
You agree that your Feedback does not infringe any third party's rights. You are solely responsible for all Feedback you provide and its accuracy. We assume no obligation and accept no liability for Feedback submitted by you or third parties.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, prices, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information is inaccurate, without prior notice (including after you have submitted your order).

You may only access and use the Services for lawful purposes. In addition, you agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish or otherwise abuse the Services; (e) use robots, spiders, scraping or AI tools to access the Services; or (f) interfere with or circumvent security features. We reserve the right to terminate your account without notice if you violate these Terms.

14.1. This section applies if you use or permit an agent to access, use or interact with the Services. "Agent" means any software or service that performs autonomous actions on behalf of a person.

We may terminate this agreement or your access to the Services at our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply after any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law and Privacy Policy.

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information.
EXCEPT AS EXPRESSLY STATED BY IT'S BUBBLES O'CLOCK, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
Consumer rights: The above disclaimers do not, however, limit your non-waivable rights as a consumer under applicable law, including the statutory 24-month right of complaint for defects under the Sale of Goods Act.

SECTION 17 – LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, IT'S BUBBLES O'CLOCK, OUR PARTNERS, DIRECTORS, EMPLOYEES, AGENTS OR SHOPIFY SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY DAMAGES, LOSSES, CLAIMS OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS OR LOSS OF DATA, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS.

SECTION 18 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless It's Bubbles O'clock, Shopify and our affiliates from any losses, damages, liabilities or claims, including reasonable legal fees, payable to third parties arising from or in connection with (1) your breach of these Terms of Service, (2) your violation of any law or third-party rights, or (3) your access to and use of the Services.

SECTION 19 – SEVERABILITY
In the event that any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service, without affecting the validity of the remaining provisions.

SECTION 20 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding all prior agreements. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 21 – ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights without our prior written consent. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

SECTION 22 – GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide Services to you shall be governed by and construed in accordance with the laws of Denmark. Any dispute arising in connection with these Terms or your purchases shall be resolved by the Danish courts.

SECTION 23 – HEADINGS
The headings in this agreement are included for convenience only and shall not limit or otherwise affect these Terms.

SECTION 24 – CHANGES TO THE TERMS OF SERVICE

We reserve the right at our sole discretion to update, change or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check our website periodically for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
